Terms and Conditions of Incallup

As of the date shown above, these terms of use are still in effect. We periodically revise these Terms of Use, so we encourage you to review any updates that have occurred since you last utilized the services provided by the Incallup.com website (the "Site").
 
 The offeror and recipient users (collectively referred to as "Users") are among the users of the site.
 
 In compliance with the rules listed below for Paid Services, Offeror Users are allowed to post advertising and establish profiles in addition to creating material that is shown on the Site. Recipient Users are able to view content published by Offeror Users and are provided with the option to get in touch with them using the contact details they have uploaded.

Users are recommended to close the Site and stop using the service if they do not desire to be bound by the Terms of Use, as browsing the Site further indicates assent to the terms in effect at the time of visit.

Our privacy policy, which details how we use cookies and related technologies, governs how we use your personal data. We only collect the minimal amount of personal information that is required under applicable law in order for us to fulfill our legal obligations, provide the service in accordance with these Terms of Use, and further our legitimate interests in enhancing the service, expanding its geographic reach, and advancing the security and welfare of our Users.

If you would like to become an Offeror User, you must affirm that you agree to the terms of use, which include the Acceptable Use Policy, Summary, and Guidelines, as stated below, at the time that you place the advertisement or create the profile.

Please be aware that incallup is the site's operator and that it simply serves as a platform ("we" or "us"). We do not prescreen user profiles or advertising posted on the site; nonetheless, we will remove any such profiles or advertisements that:

• Violate our terms of service; or
• Include any malware or other anything that might potentially tamper with or impair the Site's functionality; or
• We deem, at our sole discretion, to be detrimental to the service's proper functionality; or
• We believe to be illegal in nature (such as anything that involves harassment, defamation, obscenity, pornography, paedophilia, libellous speech, invasion of privacy, or harm to children in any manner), or that might violate any relevant criminal laws or rules that govern us; or
• Constitute, or have the potential to, intimidate or harass another user or other third party; or
• Are intimidating, harsh, or prejudiced; or
• Are mandated by a court order from an appropriate court or other government

We have implemented a "Report Abuse" feature on the website that allows users to report advertisements that they believe violate these terms of use. Specifically, users can report advertisements that they believe contain underage content, were not published by or with the consent of the person who appears in them, or are illegal in some other way. All advertisements that are reported to us will be reviewed, and we will decide whether to accept the complaint and remove the advertisement, demand further documentation from the Offeror User who placed the advertisement to confirm their age or right to place it, if applicable, or reject it.

Although it is up to Users to ascertain for themselves the laws applicable to any material they contribute to the Site and whether or not such material complies with the Terms of Use, the sections labeled "Acceptable Use Policy" and "Summary and Guidelines" provide more detail about what is considered to be in violation of these Terms of Use.

If a user repeatedly or seriously violates our terms of use, we retain the right to prohibit them. We will not be liable for any losses, claims, damages, or other costs resulting from the removal of any advertisement or the banning of any user. Refunds for any money paid to us will not be given, with the exception of the specific circumstances outlined in the "Refunds Policy" section below.

Using this website in any way to encourage or assist in the trafficking of people, sex trafficking, or physical abuse is strictly forbidden. If any content that appears to be indicative of sex or human trafficking is found, we will suspend the account right once and work with law enforcement to help identify the offenders.

DUTY AND ACTIVITIES OF THE USER

Users represent and warrant that they are at least eighteen years old by using the adult-only service. It will be a violation of these Terms of Use for any User under the age of 18 to falsely claim that they are 18 or older or to get around any age verification procedures we may have placed in place. 
 
 As previously mentioned, Recipient Users should be informed that we have no prior control over the content of the advertisements that Offeror Users post online. The Site does not act as a middleman or agent for any Users, and it disclaims all liability and responsibility for any risks, demands, or other matters resulting from any service provision or other interaction between Offeror Users and Recipient Users.

By utilizing the service, users agree to take complete and sole responsibility for how they behave toward the website, other users, and third parties in general. 
 
 We disclaim all liability for the accuracy of any advertising posted by Offeror Users and make no guarantees regarding the result of any agreements between Offeror Users and Recipient Users.

Restrictions on Liability 
 
 Nothing in these Terms of Use shall be construed to restrict or waive any party's responsibility for fraud, death or bodily damage brought about by that party's negligence or the carelessness of any person for whom they are liable, or for any other liability not permitted by law.

The Site's and its affiliates', and its or their affiliates' managers, employees, officers, or directors' liability to Users for any other losses and damages, whether arising in contract, tort, breach of statutory duty or under any legal theory whatsoever arising out of or in connection with the Site and the services shall (without prejudice to the Refunds Policy set out below), in the case of paid-for services, be capped at an amount equivalent to the higher of the sums

A determination of nullity or unenforceability regarding any one of the aforementioned provisions or sub-provisions will not impact the enforceability of the remaining provisions, which will continue to be in full force and effect. All of the aforementioned provisions and sub-provisions are distinct and independent laws.

Offered Services: Provider Users

By posting an advertising on the Site (which includes making an online profile), each Offeror User grants us permission to run the service in a way that maximizes efficacy in pertinent geographic areas and to promote it for increased exposure at our discretion. Offeror Users attest that they are of legal age in the applicable jurisdiction, that they are the person shown in that profile, and that they have not been subjected to any kind of coercion by creating an online profile or running an advertisement on the Site.

An offeror user's publication of an advertising cannot in any way violate the rules and laws that apply in the offeror user's jurisdiction or nation of residence. We retain the right, in the event of a breach of these terms or a violation of the relevant laws and regulations, to remove the advertisement without providing a refund, to delete any relevant profile, and to prohibit Users from making any further profiles or posting any more advertisements.

Please be aware that Incallup does not meddle in the discussions that Users are having.

Policy for Refunds 
 
 We do not give Offeror Users their money back when they pay for spent Services; but, in extreme cases, and at our complete discretion, we may give credit for money spent that is not utilized for Paid Services in the future. Specifically (but not just)

• The Offeror User's access to the website may be restricted for a necessary period of time for maintenance, technical issues, or other reasons without prior notice. We also reserve the right to intervene via the Site or to make any modifications or changes (e.g., design, focus, and/or functional content) therein. In such circumstances, no Offeror User may, in accordance with this policy, make a claim for reimbursement or compensation based on the modification, revisions, or unavailability.
• In the event that a financial institution or platform requests a refund of any money paid for Paid Services, we reserve the right to block the Offeror User's profile on our payment provider's account until we hear from the payment provider that the matter has been satisfactorily resolved for both the financial institution and the platform.

Refunds: According to the policy, sums paid by Users for Services do not often include refunds. This implies that you might not be eligible for a refund after you've paid for a service. 
 
Extra Credit: The policy lists a few circumstances in which the business may, at its complete discretion, extend credit. You can put this credit toward any upcoming paid services. It's crucial to remember that this is a discretionary action rather than an obligatory entitlement.

Site Maintenance and Changes: The business maintains the right, at any time and without prior notice, to make modifications or changes to the website, including its functional content, design, and emphasis. It could also restrict User access to the website for upkeep or technical issues. Users in such circumstances are not entitled to reimbursement or compensation for these modifications, adjustments, or brief outages. 
 
Blocking of User Profile: The business retains the right to block a user's profile in the event that one of the payment processors for the firm receives a refund request from a bank or another platform. The corporation will have the last say over any unblocking.

Policy for Acceptable Use 
 
 Users agree not to use the services offered by the Site in an inappropriate manner or in violation of any relevant laws, rules, regulations, ethical guidelines, or good behavior guidelines for network services. In particular, users agree not to post content on the site that is libellous, offensive, harassing, defamatory, pornographic, paedophile, vulgar, blasphemous, or in any other way at odds with morality or public order.
 
 
 It is the Offeror Users' responsibility to ensure that the content of their advertisement complies with all relevant regulations. Specifically, users are not allowed to promote any services or post any information that is illegal to do so in their area.

Providers of advertisements warrant that none of the individuals whose personal data appears in them are their property or that they have their informed and explicit consent. Additionally, they pledge not to utilize any content in their adverts without the permission of third parties whose copyright or other intellectual property rights are violated. 
 
 Advertiser Users acknowledge that when they provide an email address in one of the Site's advertisements, we do not have any control over any content that could be delivered directly to that address, from other Advertisers or elsewhere.

Overview and Recommendations 
 
 We specifically direct Offeror Users' attention to the following synopsis of the Terms of Use mentioned above. Please note that we provide this summary to our users for their convenience only and that it is not intended to serve as legal advice on what may or cannot be included in advertising or profiles.

• It is not permitted to include pornographic photographs that include explicit genital images or other obscene imagery, or that otherwise contain content that would be considered obscene and in violation of the relevant laws and regulations;
• Anything that goes against the guidelines regarding "extreme pornography," such as erotic content that shows seemingly non-consensual acts, acts involving animals, acts that resemble sexual acts with dead bodies, or acts that seem to threaten someone's life or that are likely to cause serious harm to someone's genitalia, breasts, or anus, is prohibited;
• Anything that uses explicit content shared privately ("revenge porn") without permission from each participant is prohibited;
• Any paedophile content that is included into an advertising or profile will be reported right away to the appropriate authorities, together with all access and meta data. Additionally, we have the right to report any content that violates our policies against severe or retaliatory pornography;
• By posting ads or creating profiles, users attest to their full legal authority and declare and warrant that the content they upload is the property of adults (18 years of age or older) who have granted the site permission to publish it with their free and informed consent;
• Before posting an advertisement on the Site (which includes making an online profile), each Offeror User will verify using the [incallup.com/verify] that they are the person named in that profile, that they are of legal age in the applicable jurisdiction, and that they have not been subjected to any form of coercion. The Offeror User will not be permitted to post their advertisement or utilize the service until they provide this confirmation;
• The same advertising may be run in a maximum of three distinct cities;
• The same advertising cannot be run more than once in the same city within the same period of time; and
• Hypertext links are not allowed in any kind of marketing or profile.

In accordance with these terms and conditions, we shall manage the service at our own discretion, with the goal of enabling optimal efficacy in pertinent geographic areas.

Users are not permitted to use the Site to engage in deceptive or misleading behavior, to promote illegal trading, Ponzi or pyramid schemes, or to engage in any other activity that could mislead or deceive other users. Additionally, users are not permitted to imply, in false representation of the truth, that any individual or organization supports a user or their content, or that the user is acting as a brand ambassador or representative of someone else. Any content that the website knows or has reason to suspect violates any of the aforementioned policies will be removed. Under the exclusive jurisdiction of the Cypriot Courts, these Terms of Use shall be construed and controlled by the laws of the Republic of Cyprus.
